Link Properties sues Brilliant Education over HK$1.88m of unpaid rent

Link Properties has filed a writ to the High Court and asked suddenly-shuttered Brilliant Education to pay over HK$1.88 million in unsettled rent for their branch in Ho Man Tin. 

The writ listed Lzye (Ho Man Tin) Ltd and Brilliant’s headmistress Pang Tse-tung as the respondents. 

The involved unit is located at Shop 11, G/F, Homantin Plaza. 

Link said in the writ that it signed a fixed five-year contract with Lzye, starting from May 2019 to April 2024. The monthly rent for the first three years was HK$210,000 and that for the remaining two years would be HK$240,000. 

Yet, Lzye has failed to pay rent since this February and the debt accumulated to over HK$1,884,000 as of yesterday, including other service charges and government rates. 

Link also said their lawyer had sent a letter to Lzye and Pang on July 28 and asked them to pay rent but in vain. Link therefore decided to terminate the tenancy agreement and requested the Lzye and Pang to return the vacant possession of the shop in the next three days, which they failed to do so. 

As for the branch in Chai Wan, a notice issued by Pang at the entrance said the education center abides by the law and relevant regulations stringently and is now arranging for all branches to resume classes. 

Pang also called for students’ understanding over the classes they have paid for that the school now can’t provide. 

Pang said they can enroll in other classes for free. And if they are not willing take other classes, the school will discuss with them on how to tackle the issue. 

Brilliant, founded in 1996, ran five branches throughout the city; the other three in Kornhill, Shau Kei Wan and Siu Sai Wan.
