The defendant Liu Hui-yin earlier pleaded guilty to a count of loitering causing concern and appeared before magistrate Jason Wan Siu-ming at West Kowloon Court today for his sentence.
Handing down the probation order, Wan said this case was of a serious nature and the court could have imprisoned Liu but noted that Liu showed remorse and learned a valuable lesson.
The magistrate pointed out that Liu acted positively to eradicate his issues, saying he deserved a second chance and a probation order would be the appropriate sentence.
Wan also reminded Liu to follow orders from the probation officer and to participate in interventions or undergo psychiatric sessions if instructed to do so.
Earlier in mitigation, the defense cited a positive background report for Liu and noted that he proactively admitted his wrongs. The counsel also said Liu had a clean record and was in need of treatment rather than punishment.
The court earlier heard that in the afternoon on November 20, a female teacher “X” walked past the stairs on the 1/F of Buddhist Tai Hung College and saw Liu – dressed as a school girl – walking towards the 2/F.
X then intercepted and questioned Liu and Liu replied with a very weak voice that “she” planned on going back to “her” homeroom. X further asked Liu which class “she” was from and Liu immediately fled the school through the front door towards So Uk Estate.
X soon informed the principal of the incident and checked the security camera footage before filing a police report. Liu was subsequently arrested around 10.30 pm that night in the car park of his home.
