The enforcement of prenuptial agreements will be assessed on an individual basis, even though these agreements are not currently legally binding in Hong Kong.
Secretary for Home and Youth Affairs Alice Mak Mei-kuen told lawmakers yesterday that while there are no specific legal provisions governing prenuptial agreements, courts may consider the terms based on the circumstances and conduct of both parties involved.
She cautioned that mandating the enforcement of these agreements could lead to unfair property divisions, especially in light of unforeseen events that may arise after the agreement is made.
Highlighting the court's discretionary powers, Mak asserted that the existing legal framework is capable of ensuring equitable property division for both parties in a marriage. "The current regime ensures the court can, after fully considering the contents of the prenuptial agreement and all factors related to the division of property, arrange the division of property."She also noted that the Maintenance Mediation Pilot Scheme has successfully handled 64 cases since its inception, with half reaching mediation completion. This trial scheme supports a non-governmental organization in offering mediation services for alimony.
