Tin-yu's father announced on social media on Monday his determination to continue seeking justice for his daughter despite the rejection of the criminal prosecution process.
He stated today that back in October 2023, he provided a statement to the police at the Wan Chai police headquarters, expressing his hope to hold the doctor who allegedly modified Tin-yu's medical records accountable and to pursue a criminal case.
More than a year after his statement, he received a response from the police, who, after completing their investigation and consulting the Department of Justice, decided not to initiate criminal prosecution proceedings in this case.
Tin-yu's father expressed that he was "extremely disappointed" but affirmed that he would not give up on seeking justice for Tin-yu.
Tin-yu was diagnosed with stage 4 rhabdomyosarcoma—a rare type of cancer affecting muscle tissue—in 2018 and underwent surgery in May 2020 at Queen Mary Hospital to remove a tumor. Her parents claimed that mistakes during the surgery caused a roughly 50-minute delay in the blood transfusion.
Although resuscitation was successful, Tin-yu suffered severe brain damage due to prolonged oxygen deprivation and had been in a vegetative state ever since.
In October 2023, the family reached a settlement agreement with the Hospital Authority regarding a civil lawsuit. Although Tin-yu's father reluctantly accepted the settlement, considering it the best option at the time, he remained determined to seek accountability for the alleged modification of Tin-yu's medical records and to pursue a criminal case.
The young girl, who had been in a vegetative state for over three years due to a medical accident, passed away on March 10, 2024.
