The Independent Commission Against Corruption (ICAC) apprehended four men for allegedly encouraging others not to vote at the Legislative Council General Election (LegCo Election).
The suspects, aged between 37 and 62, are accused of sharing an online post or making comments on social media platforms to incite others not to vote or to cast invalid votes, potentially violating the Elections (Corrupt and Illegal Conduct) Ordinance.
The ICAC had earlier charged three other individuals with the offence in relation to the current LegCo Election.
It has pledged to thoroughly investigate the matter, following established legal procedures, and will consult with the Department of Justice regarding potential prosecutions once the investigation concludes.
It reiterates that publicly inciting others not to vote or to cast invalid votes during the election period is a violation of the ECICO. A total of 12 individuals were convicted of the offence since the new provision under section 27A of the ECICO was introduced in 2021.
Any person who violates the provision is liable on conviction to a maximum penalty of a three-year imprisonment and a fine of HK$200,000.
