A 44-year-old Filipino domestic helper was sentenced to seven weeks in prison at Shatin Magistrates’ Court after being found guilty of child abuse for accidentally scalding a one-year-old boy she was caring for in an incident that left the toddler with severe burns requiring skin grafts.
On March 3, at a residence in Kwong Sin Street, Sha Tin, Nora Campos Navarro placed the infant on the kitchen floor while preparing food.
The child grabbed the power cord of an electric rice cooker, causing it to topple and spill hot water over both of them.
The boy suffered superficial second-degree burns to his right hand and left foot and a deeper second-degree burn on his right forearm, necessitating a skin graft using artificial dermis.
Navarro, who also sustained minor injuries, was arrested and charged with ill-treatment or neglect of a child under her care.
After a trial, the magistrate ruled that the boy’s injuries were serious and that a custodial sentence was unavoidable.
While acknowledging Navarro had no prior criminal record and a low likelihood of reoffending, especially as she would likely not continue working as a domestic helper in Hong Kong, the court started with an eight-week jail term and reduced it by one week.
The magistrate noted that similar child neglect cases often involved intentional harm, but the severity of the toddler’s injuries in this instance warranted imprisonment.
The defense argued that Navarro had not intended to harm the child and that the incident stemmed from a moment of carelessness during routine caregiving.
They cited precedents suggesting non-custodial sentences for negligence and highlighted that Navarro had already lost her job, suffered injuries, and spent two weeks in custody as sufficient punishment.
However, the court maintained that the child’s serious injuries justified a prison term.
