The government’s proposed framework to recognize same-sex partnerships is absolutely not equal to heterosexual marriages, Secretary for Constitutional and Mainland Affairs Erick Tsang Kwok-wai told lawmakers.
This comes as the draft mechanism was introduced to the Legislative Council yesterday for first and second readings when several major political parties with conservative views have voiced strong opposition.
Speaking at LegCo, Tsang said, “although public opinion may not be entirely aligned, and at times may appear sharp, this precisely reflects the value of the legislature,” describing lawmakers’ opinions as “valuable.”
However, after thorough consideration, the government decided to push ahead with the proposal. Tsang said the decision shows the SAR administration’s “unwavering determination” to uphold the rule of law and full respect for the Court of Final Appeal’s ruling.
He reiterated that the proposed same-sex recognition is nowhere near equivalent to the city’s only legal marriage system, the union between a man and a woman, saying “there is absolutely no leeway,” meaning such a distinction is non-negotiable.
Tsang emphasized that the rule of law is the foundation of investor confidence and Hong Kong’s success, and its violation carries serious consequences.
"The country has long stressed governance by law – without rules, order and development are impossible.”
He warned that failing to fulfill the legal obligations would breach the rule of law and bring serious consequences, calling on lawmakers to approach the bill with reason, objectivity, and professionalism.
The bill proposes a new registration system to legally recognize only same-sex marriages registered overseas, granting them rights to handle medical matters and after-death arrangements.
