Various media outlets have discussed the legality of such a sale by "a well-known Hong Kong enterprise," referencing the principles of Article 23 legislation and suggesting that the sale could be illegal.
Starry Lee Wai-king, Hong Kong's sole delegate to the National People's Congress Standing Committee, emphasized the strategic importance of port business.
She stated on a television program that it is challenging to separate politics from economics, especially given the complexity of current geopolitical issues.
Lee highlighted that many countries have specific entry thresholds for strategic industries, suggesting that enterprises should prioritize national development when making commercial decisions.
Tam Yiu-chung, a former member of the Standing Committee of the National People's Congress and vice president of the Chinese Association of Hong Kong and Macao Studies, echoed these sentiments.
After attending an event, Tam addressed the press, stressing the significant impact and public attention drawn to the issue due to its implications for national security and import-export trade. He urged relevant parties to proceed with caution to safeguard national security.
Regarding the potential violation of Article 23 principles, Tam clarified that the provisions are explicit and he trusts that those involved will handle the situation prudently, keeping in mind the requirements for national security.
He also addressed concerns about the impact of using Article 23 on Hong Kong's free economy, labeling it a hypothetical scenario and underscoring the necessity for enterprises to act cautiously and legally, particularly in matters related to national security.
