Tin-yu was diagnosed with stage 4 rhabdomyosarcoma—a rare type of cancer affecting muscle tissue—in 2018 and underwent surgery in 2020 at Queen Mary Hospital to remove a tumor. Her parents claimed that mistakes during the surgery caused a roughly 50-minute delay in the blood transfusion.
After being informed by the Department of Justice (DoJ) that no criminal prosecution would be initiated, Tin-yu's father sought the assistance of barrister Albert Luk and wrote to the police requesting further information about the case and investigative data.
Two days later, he received a response from the police indicating that since the case might be subject to a future coroner's inquest, they are currently unable to provide additional information.
Expressing his dissatisfaction with the police's response, Tin-yu's father argued that the potential convening of a coroner's inquest makes it even more crucial to verify the authenticity of the medical records beforehand.
He emphasized that the medical report is the most vital and compelling evidence that could directly prove whether any errors were made by the doctors, which would influence subsequent proceedings. He raised concerns that if the medical record has been falsified, it could lead to erroneous judgments.
Tin-yu's father also claimed that the DoJ's decision not to prosecute might have been influenced by either an incorrect investigative approach by the police or a lack of thoroughness in their investigation.
He strongly demands that the police disclose the contents of their investigation immediately to ensure transparency and justice in the handling of his daughter's case.
