Bryan To Hang-lam, 36, a businessman, entered a bargain plea before the start of the trial yesterday on one count of assault occasioning actual bodily harm before deputy magistrate Tsang Chung-yiu at Sha Tin Magistrates’ Court.
Tsang accepted the proposal to drop the charge, but bound him over for 12 months.
However, it was objected by the prosecutor and Tsang later changed the period to three years instead of 12 months.
To was also ordered to pay a HK$300 legal cost.
The court heard that on May 13 this year, To’s girlfriend, Leung Hung-yuk, visited To at his Sha Tin home.
They soon headed to a school in To’s car to pick up his daughter, with To sitting in the driver’s seat and Leung in the front passenger seat.
As the car reached Tate's Cairn Tunnel, the two argued over their relationship. At the height of the quarrel, To punched Leung in her right eye socket and on her nose bridge several times.
After returning to To’s home with his daughter, Leung hid inside the bedroom and called her friend for help.
At 4pm on the same day, police arrested To at his home after which To admitted he had hit Leung to officers.
Leung was later sent to Prince of Wales Hospital in Sha Tin, where bruises and scars in her right eye socket and on her nose bridge were found, along with swollen jaw and right wrist, as well as a split fingernail on one of her ring fingers.
