A 34-year-old former McDonald’s manager was sentenced to two years in prison on charges of indecent assault against a minor and threatening to distribute intimate images without consent.
The defendant, Kong Yiu, was convicted of molesting a 15-year-old female subordinate in March 2022 inside a McDonald’s staff changing room in Wan Chai. According to court evidence, he kissed and groped the victim referred to as X, then pressured her into performing oral sex, telling her, “I like it when you suck me.”
Later, in September 2022, when X attempted to end the relationship, Kong threatened to leak her intimate photos unless she agreed to “one last sexual encounter” with him. In WeChat messages, he urged her, “Uncle advises you to come for one last time,” causing X significant distress until she threatened to report him to the police.
Judge Josiah Lam Wai-kuen emphasized that although X appeared to participate willingly, her age (15 years and 8 months at the time) rendered her legally incapable of consent. As a man in his 30s, Kong knowingly committed illegal acts with a minor, warranting imprisonment.
The judge also noted Kong’s attempted distribution in 2023 of an explicit photo—allegedly of the victim—to another woman. However, due to insufficient evidence, the charge of publishing intimate images was dismissed.
Kong’s lawyer appealed for leniency, highlighting his clean criminal record, employment as an elevator technician, and charitable acts such as blood donation. Despite this, Judge Lam upheld the two-year sentence, emphasizing the seriousness of exploiting a minor and using revenge porn as a form of coercion.
Kong was acquitted of one charge related to sharing explicit content but convicted on two others: indecent assault of a child under 16 and threatening to distribute private images.
