The Independent Commission Against Corruption (ICAC) has obtained arrest warrants for two men who published online posts to incite others not to vote for the upcoming Legislative Council election following three arrests for reposting the contents.
The anti-graft watchdog charged two men and one woman on Thursday after apprehending them last Friday (Nov 14) on suspicion of breaching section 27A of the Elections (Corrupt and Illegal Conduct) Ordinance (ECICO).
Three defendants include Wong Kin-kwok, 55, air-conditioning engineer, Lam Kin-sik, 66, unemployed, and Bonney Ma Wai-ling, 61, housewife.
They are accused of reposting a post on their social media platforms during the 2025 LegCO election period that incited others not to cast their votes at the election.
Each of them faced one count of engaging in illegal conduct to incite another person not to vote by activity in public during election period.
The case will be heard at the West Kowloon Magistrates’ Courts this afternoon.
Nominations for the 2025 LegCo Election opened on October 24 this year. According to the ECICO, the period from that date until polling day on December 7, is designated as the “election period.”
At the ICAC’s request, a Magistrate also issued warrants for the arrest of two other suspects who have reportedly left Hong Kong.
The wanted individuals include Keung Ka-wai, 34, and Tong Wai-hung, 44.
Both face two counts of engaging in illegal conduct to incite another person not to vote by activity in public during election period.
ICAC’s investigation revealed that Keung and Tong displayed posts on their social media pages that incited others not to vote in the election. Wong subsequently reposted Keung’s content on his social media platform, while Lam and Ma reposted Tong’s content on their pages.
ICAC strongly condemns criminals spreading messages online to incite others not to vote, attempting to interfere with and undermine the election.
It emphasized that such actions may violate section 27A of the ECICO, and reposting this content also constitutes a breach.
ICAC said it will uphold a clean election and firmly prevent and combat any acts that interfere with or undermine the election to ensure that the election is conducted fairly, openly and honestly.
