19-year-old sentenced to one year in prison for promoting seditious activities

A 19-year-old woman who filmed promotional videos for a subversive organization named the "Hong Kong Parliament" and incited and encouraged others to vote for the organization was sentenced to one year in prison.

The defendant Lan Fei, who is also the ex-girlfriend of the fugitive Tony Lam, pleaded guilty to one count of "doing with a seditious intention an act or acts that had a seditious intention" and was sentenced to prison at the West Kowloon Magistrates' Courts on Thursday.

Lan was involved in producing promotional videos and appealed to others through social media platforms to vote for the purpose of overthrowing and undermining the body of the central power of People's Republic of China or the body of power of the HKSAR between March and May this year.

The defense cited a background report indicating that the defendant fears her sentencing but is willing to accept responsibility, understanding her life will change, even if released.

The report notes her emotional dependency on her ex-boyfriend and suggests she was innocent, not realizing her actions would lead to serious charges. 

Lan left Hong Kong at the end of last year and was arrested upon her return to Hong Kong in June after filming the promotional videos. 

Under caution, she said she filmed the video at the request of her then-boyfriend, Lam. She also quoted him as saying that the filming was not illegal and that she would be awarded 100 Canadian dollars (approximately 550 Hong Kong dollars) per video.

Lam is identified as one of the participants in the "Hong Kong Parliament." The defense said that Lan and Lam began their relationship at the end of the previous year, and she had accompanied Lam during trips to Taiwan and Canada. Their relationship ended after more than a year. 

The defense said Lan's family had advised her against returning to Hong Kong; however, she decided to proceed with her return, highlighting her lack of understanding regarding the prevailing legal and political circumstances.

The defense seeks leniency due to her immediate guilty plea. 

Chief Magistrate Victor So Wai-tak set a 16-month starting point for sentencing, adding two months for international elements, resulting in a final sentence of 12 months after the guilty plea reduction.
