Kindy director jailed for child porn

A former male director of a kindergarten was sentenced to three months' imprisonment by a Kowloon City magistrate yesterday after being convicted of filming a four-year-old girl using the toilet.

Eric Ma Cho-yiu, who pleaded not guilty to making child pornography on July 30, has been granted bail of HK$20,000 pending appeal, but he is not allowed to leave Hong Kong.

Ma, 38, produced a child pornographic video, which shows a young girl urinating and exposing her private parts at his flat on Austin Road West sometime between August 2014 and November 2018.

Magistrate Raymond Wong Kwok-fai refuted Ma's claims that the girl was filmed by accident.

He said anyone installing a camera at their own house "would have expected that anyone entering the toilet would be filmed."

Wong added that although the video filmed by Ma was short, lasting around two seconds, the nature of the crime was more serious as it involved child pornography.

The video was saved on a USB flash drive that was lost in a mall. Someone later picked it up and called the police after finding clips showing women using the toilet and bathing as well as a child using the toilet.

Ma was arrested in November 2018 and was charged with access to a computer with dishonest intent. He was initially released unconditionally last May after he was found not guilty but was charged again with making child pornography in October.

There were nine clips in the USB flash drive, involving three of his subordinates and the young girl. Ma also appeared in the clips and was filmed adjusting the camera angle. Wong said the only inference was that Ma placed a camera in the bathroom on purpose to film victims secretly.
